QI had bought a flat in Ahmedabad after paying full cost, stamp duty & registration charges to a reputed builder, got allotment & peaceful possession frm builder & m staying there since 29/11/2013. Builder prepared proper sale deed on stamp paper, took my sign & PAN/Adhar cards but never submitted same for registration & was avoiding me for it. I hv got all my cheque payments entry in my bank statements with me, builders' receipts for all payments, no due certificate, allotment letter, possession letter. In April, 2014, he was arrested for frauds in all his ongoing multiple projects. After his arrest, I came to know dat he had taken project finance from Kotak Mahindra Bank agnst mortgage of land on which bldg is constructed. Also, he had borrowed some amount from pvt finance company of some Marwadi agnst a registered banakhat. Kotak Bank has gone in Debt Recovery Tribunal (DRT) for recovery of their amount. My 3 neighbors hv got their sale deed registered, out of them 2 hv also taken housing loan frm Axis Bank & Vijay Co-op Bank. Now, DRT has issued all of us notice to vacate our flats. V all hv filed a case in 2014 agnst builder for committing fraud wth us. Marwadi financer is now gvng bribe to DRT officer & is trying to get our flat vacated. Pls guide what course of action we cn take to protect custody of our flat wth us. We all hv filed city civil case agnst builder & hv got city civil court commission done & city civil court has issued order to maintain 'Status Quo' for our flats. Now, pls guide us what can be done immediately to keep custody of our flats with us & we should not dispossess our flats. We are staying wth our family. For Marwadi financer, it was investment whereas for us, its our dream home. Pls help at d earliest. Rgds.
